The Kogi State governor, Captain Idris Wada, who is also the governorship candidate of the Peoples Democratic Party (PDP) in the inconclusive election in the state, has asked a Federal High Court to stop the Independent National Electoral Commission (INEC) from asking the All Progressives Congress (APC) to substitute the late governorship candidate of the party, Prince Abubajar Audu. The election held in Kogi State on November 21 was declared inconclusive and shortly after the announcement, the APC candidate, Prince Audu, died suddenly. The APC candidate was leading in the election results announced by INEC. In the suit at the Federal High Court, Abuja, the governor asked the court to stop INEC from conducting the proposed supplementary elections with another candidate expected to be fielded by the APC. In a 15-page originating summon filed by his counsel, Chris Uche (SAN), the governor and the Peoples Democratic Party (PDP) want the court to determine the legality or otherwise of the decision to substitute the APC candidate after the election had been concluded in many polling units. The governor also wants the court to declare as illegal, the decision of the APC to substitute its candidate after the governorship candidate of the party died. In the alternative, the plaintiff is asking the court to order a fresh governorship election within a specified period. No date has been fixed for hearing.
